Law to enforce new home warranty

30 Dets 2019, 19:01

I am trying to find the English version of a law/act that I believe was introduced in 2015. The law was introduced to enforce a 2 year warranty for newly constructed homes. So, in other words, the construction company must fix faults found by the new home owner in the first 2 years of ownership.

I know that I can find all the recent acts on the web site, but I do not know the name of the act in either Estonian or English.

Also, if you know about a summary of this law in non-legal language, this would also be very helpful.

Many thanks for your help!

- On 1 July 2015, the Building Code entered into force, removing the concept and obligation to provide a building guarantee.
- A warranty on a building can now only be obtained by agreement between the builder and the beneficiary. In the absence of an agreement, there will be no warranty on the building after accepting the work from the builder.
- Regardless of whether there is a building warranty agreement with the builder, the consumer is protected by the law of Law of Obligations Act ( ... /consolide) . By law, it is assumed that if the property is sold to the consumer, or if the builder builds the building for the consumer, the defects found within two years were present at the time of purchase or upon delivery of the building. If defects are found, the consumer does not have to prove, within two years, that the defects were present at the time of purchase or at the time of delivery of the building.
